Lohan tested positive for alcohol one month after rehab release

Lindsay Lohan has applied for a house arrest program and could end up serving just 14 days due to severe jail overcrowding.

LOS ANGELES ? Lindsay Lohan tested positive for booze one month after her release from Betty Ford, according to a probation report released after she copped a plea today in her necklace theft case.

The troubled "Mean Girls" star had alcohol in her system Feb. 8 -- one day before she had to stand before a judge and face arraignment on a felony grand theft charge related to the diamond necklace she took from a Venice, Calif., jewelry store in late January, the report stated.

The theft charge was reduced to a misdemeanor last month, and Lohan pleaded "no contest" through her lawyer Shawn Holley this morning.

"Her recent positive test for alcohol use and the allegations in the (necklace theft) matter are troubling in that she continues to violate the law, despite prior grants of probation and county jail time," the probation report dated Feb. 22 stated.

The report, prepared when the case was still a felony, says Lohan was tested on five occasions after her Jan. 3 release from Betty Ford.

"The probation officer believes that substance abuse is the root of the defendant's problems," the report said.

Despite the dirty test, a county judge declined to order substance abuse treatment for Lohan after she accepted her plea deal today.

"I'm not going to order substance abuse counseling...I don't think that's the root of her problem," Judge Stephanie Sautner said. "She's got other problems for which she self medicates."

Sautner ordered Lindsay to serve 120 days in county jail and 480 hours of community service, the exact same sentence she gave her for violating her probation with the necklace theft.

The two sentences will run concurrently, the judge said.
